{"id":2223,"date":"2021-02-27T00:51:05","date_gmt":"2021-02-27T00:51:05","guid":{"rendered":"http:\/\/tvyou.ca\/canada\/?page_id=2223"},"modified":"2021-02-27T06:57:40","modified_gmt":"2021-02-27T06:57:40","slug":"intra-company-transfer","status":"publish","type":"page","link":"https:\/\/tvyou.ca\/canada\/intra-company-transfer\/","title":{"rendered":"Intra Company Transfer"},"content":{"rendered":"\n<p>If you work for a company that has a parent company, branch, subsidiary, or affiliate in Canada, you may be able to secure a&nbsp;<a href=\"https:\/\/moving2canada.com\/immigration\/canadian-work-permits\/\">Canadian work permit<\/a>&nbsp;through the Intra-Company Transfer program.<\/p>\n\n\n\n<p>Employers bringing international staff to Canada as intra-company transferees are exempt from the requirement to obtain a&nbsp;<a href=\"https:\/\/moving2canada.com\/lmia\/\">Labour Market Impact Assessment (LMIA)<\/a>. For this reason, the process can be quicker, simpler, and more cost effective than the LMIA route.<\/p>\n\n\n\n<p>Qualified intra-company transferees provide \u2018significant economic benefit to Canada\u2019 through the transfer of their skills and expertise to the Canadian labour market. Intra-company transferees may be from any country.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Intra-Company Transfer categories<\/h2>\n\n\n\n<p>In order to be eligible to work in Canada under the Intra-Company Transfer program, foreign workers must fall into one of three defined categories:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Executives<\/strong>&nbsp;primarily direct the management of the enterprise, or a major component thereof,&nbsp;and receive only general (if any) supervision from higher level executives.<\/li><li><strong>Senior managers<\/strong>&nbsp;manage all or part of the enterprise and supervise or control the work of other managers or professional employees.<\/li><li><strong>Workers with \u2018specialized knowledge\u2019<\/strong>&nbsp;can demonstrate specialized knowledge of the enterprise\u2019s product or service, or an advanced level of expertise in the enterprise\u2019s processes and procedures.<\/li><\/ul>\n\n\n\n<p>In all cases, workers being transferred to Canada must have at least one year of full-time work experience with the foreign enterprise and be coming to Canada to perform comparable work. There must be a&nbsp;<a href=\"https:\/\/www.canada.ca\/en\/immigration-refugees-citizenship\/corporate\/publications-manuals\/operational-bulletins-manuals\/temporary-residents\/foreign-workers\/labour-market-impact-assessments\/intra-company-transferees\/canadian-interests-significant-benefit-qualifying-relationship-between-canadian-foreign.html\" target=\"_blank\" rel=\"noreferrer noopener\">qualifying relationship between the employer and employee<\/a>&nbsp;in order for a work permit to be issued.<\/p>\n\n\n\n<p><a href=\"mailto:?subject=Intra-Company%20Transfers%20to%20Canada&amp;body=%20https:\/\/moving2canada.com\/intra-company-transfer-canada\/\"><\/a><a href=\"https:\/\/www.linkedin.com\/shareArticle?mini=true&amp;url=https:\/\/moving2canada.com\/intra-company-transfer-canada\/\"><\/a><a href=\"https:\/\/twitter.com\/share?url=https:\/\/moving2canada.com\/intra-company-transfer-canada\/&amp;text=Intra-Company+Transfers+to+Canada\"><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Intra-Company Transfer work permit duration<\/h2>\n\n\n\n<p>Immigration, Refugees and Citizenship Canada (IRCC) stipulates that initial work permits granted under the Intra-Company Transfer program are typically for a one-year duration. However, these work permits may be renewed.<\/p>\n\n\n\n<p>For renewals, evidence should be provided that:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>the Canadian and foreign companies still have a qualifying relationship;<\/li><li>the new office has engaged in the continuous provision of goods or services for the past year; and<\/li><li>the new office has been staffed appropriately.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Transition to Permanent Residence<\/h2>\n\n\n\n<p>Intra-company transferees are often in a strong position to become permanent residents of Canada, should they wish to do so. Permanent residents can reside and work in any location in Canada.<\/p>\n\n\n\n<p>Since launching in 2015, Canada\u2019s&nbsp;<a href=\"https:\/\/moving2canada.com\/express-entry-canada\/\">Express Entry<\/a>&nbsp;immigration selection system has become the main driver of economic immigration to Canada. In November, 2016, intra-company transferees looking to transition to permanent residence received a major boost as IRCC changed the Express Entry system to allow these workers to obtain&nbsp;<a href=\"https:\/\/moving2canada.com\/comprehensive-ranking-system-express-entry\/\">Comprehensive Ranking System (CRS)<\/a>&nbsp;points without first being issued a LMIA. This important change has made it easier for intra-company transferees to increase their CRS score, leading to an improved chance of being&nbsp;<a href=\"https:\/\/moving2canada.com\/invitation-to-apply-express-entry\/\">invited to apply<\/a>&nbsp;for permanent residence.<\/p>\n\n\n\n<p>There may also be options to transition to permanent residence outside the Express Entry system, such as through one of the&nbsp;<a href=\"https:\/\/moving2canada.com\/provincial-nominee-program-pnp\/\">Provincial Nominee Programs (PNPs)<\/a>.<\/p>\n\n\n\n<p>Ultimately, some people who begin working in Canada as intra-company transferees may become naturalized\u00a0<a href=\"https:\/\/moving2canada.com\/canadian-citizenship-faq\/\">Canadian citizens<\/a>.
